My name is Matt Spaccarelli and I recently sued AT&T in small claims court and won.

I'm not a lawyer and I've never done something like this before. I did my own research and took my own time to put together this case against AT &T. I'd like to share my experience with all of you. I'm in the process of putting together this page to house all of the paperwork I've collected so that others may benefit from my experience. I apologize that the web site is a little rough but we just put this up a few days ago and we are working on it. An appeal from AT&T is most likely from my ruling and if you'd like to support me for future battles, please donate via Pay Pal with the link below.

My Documentation:

This is the FCC document that I used. It has some very good information on the way the FCC looks at dealing with network management and reducing speeds. Later I can be more specific about where in this 196 page document to find the points that are important.

This is the form you need to fill out to go to court anywhere in CA. Instructions are on the form just read it carefully. It's easy if you make a mistake the clerk will tell you and you can cross it out and fix it.

SC-100 Plaintiff’s Claim and ORDER to Go to Small Claims Court.pdf
This is the form you use to get information from AT&T It is called a Subpoena. I used it to request tower info on the tower closest to my house and average speeds of users. Also I included a separate sheet of paper requesting lots of other stuff. Later I will fill out all of these forms so people can see how I did it.

This is a breakdown of how many megabytes per minute a certain speed will get you.

This is the contents of my binder. I need to scan the binder

This is what I read to the judge. And at the end are questions I had for the AT@T rep. I never needed to ask the questions to the rep because small claims is very informal.
